Terms of Use

1. Welcome to J3

Please take the time to read these Terms of Use (the “Terms”) and the Privacy Policy before you sign up on j3trainings.com or use any part of the site, including any course material or other electronic service. “The site” means all content and pages within the j3trainings.com domain.

These Terms and the Privacy Policy together form the agreement between you and J3. By using the site you accept them and agree to be legally bound by them, whether or not you register an account. If you do not understand them, or you do not wish to be bound by them, please do not use the site.

J3 may modify these Terms at any time without advance notice. Any change takes effect as soon as it is posted on this page, with the effective date shown at the top. By using the site after a change has been posted you signify your agreement, on a prospective basis, to the modified Terms. We encourage you to check this page from time to time so you know the current version.

2. Our registration and accreditations

J3 is a corporation registered with the Securities and Exchange Commission (SEC) in the Philippines. We began as a partnership in 2014 and incorporated in 2016 with accreditation from the Department of Labor and Employment (DOLE) as a Safety Training and Consulting Organization.

J3 first focused on training safety officers for the construction and general industries, and later widened its scope into construction engineering and project management. Alongside our DOLE accreditation, J3 is accredited by the Professional Regulation Commission (PRC) as a Continuing Professional Development (CPD) provider.

3. Your account

To use the site you need to meet the system requirements and create an account. You must provide your legal name, an email address and a password. Depending on the course you may be asked for more information, such as your address, employer or profession. You agree to give accurate, current information and to keep it up to date.

The information you provide may be used to submit reports to regulatory bodies, to facilitate CPD unit credits with the PRC, and to let anyone verify that a J3 training certificate is genuine. This matters most for courses required for accreditation or certification with government and professional bodies, such as DOLE for safety and health courses and the Department of Public Works and Highways (DPWH) for construction and project management courses.

You are responsible for your account and for everything that happens in it, including any harm caused to J3 or to anyone else by someone using your account. That means you are responsible for your password. Never share your account or your access details with anyone. Do not transfer your account to another person, and do not use anyone else’s account.

If you contact us to ask for access to an account, our support team will not grant it unless you can provide information proving that the account is yours. In the event of a student’s death, the account will be closed.

Tell us immediately if you believe someone is using your account without permission, or if you suspect any other breach of security, by contacting us through the Contact page. We may ask you for information to confirm that the account is yours.

You must be at least 18 years old to create an account and use our services. We will terminate any account created in breach of that rule as soon as we learn of it. You may close your own account at any time; our Questions and Answers page explains how.

We care about the confidentiality and security of your personal information. Our Privacy Policy sets out what we collect and how we use it.

4. The J3 Honor Code

You are responsible for your own use of the site, and you agree to use it in line with these Terms, the Privacy Policy and all applicable Philippine and international laws and regulations, including copyright law and the laws governing the transmission of technical data. J3 places a high value on professional honesty and integrity, and expects the same from everyone who uses our services. For clarity, here is what is and is not allowed.

You agree to:

• comply with all applicable laws, including data privacy, intellectual property, anti-spam and tax laws, and regulatory requirements;
• give J3 accurate information and keep it current;
• take your course personally and complete all exams without the help of another person;
• never complete or submit an exam on behalf of someone else;
• keep only one account, and never let anyone else use your username or password;
• avoid any activity that would dishonestly improve your results, or improve or harm the results of others;
• never post or distribute answers to exam questions used to assess student performance;
• avoid any fraudulent or illegal activity connected with your J3 account;
• read the course materials, watch the course videos and complete the quizzes before taking any final exam;
• ask questions when a concept is unclear;
• use your real name on your profile; and
• use our services with integrity and in a professional manner.

You agree not to:

• create a false identity, misrepresent who you are, create a profile for anyone other than yourself, or use or try to use another person’s account;
• develop, support or use software, devices, scripts, robots or any other means (including crawlers, browser plugins and add-ons) to scrape our services or to copy profiles or other data from them;
• override any security feature, or bypass or circumvent any access control or usage limit;
• copy, use, disclose or distribute any information obtained from our services, whether directly or through a third party such as a search engine, without our consent;
• disclose information you do not have the right to disclose;
• infringe the intellectual property rights of others, including copyrights, patents, trademarks and trade secrets;
• infringe the intellectual property or other rights of J3, including copying or distributing our learning videos or other materials, or using the words “J3” or “J3TCI” or our logos in any business name, email address or URL;
• post anything containing viruses, worms or other harmful code;
• reverse engineer, decompile, disassemble or otherwise try to derive the source code of our services;
• imply or state that you are affiliated with or endorsed by J3 without our express consent, for example by presenting yourself as an accredited J3 tutor or trainer;
• rent, lease, loan, trade, sell, resell or otherwise monetise our services, the data in them or access to them, without our consent;
• use bots or other automated methods to access our services, add or download contacts, or send or redirect messages;
• monitor the availability, performance or functionality of our services for any competitive purpose;
• frame, mirror or otherwise simulate the appearance or function of our services;
• overlay or modify our services or their appearance, for example by inserting elements into them or removing, covering or obscuring anything included in them; or
• interfere with the operation of our services or place an unreasonable load on them, for example through spam, a denial of service attack, viruses or gaming our algorithms.

You also agree not to scrape or bulk-download any content from the site, including course materials, and not to misrepresent your identity while using it.

Failure to follow these Terms may result in your account being suspended, at the sole discretion of J3. If your account is suspended for fraudulent or illegal activity, no refund will be given for any purchase.

5. Course enrollment and access

J3 grants you a limited, non-exclusive, non-transferable licence to access and view the courses and associated content you have paid for, solely for your own personal, non-commercial, educational use, in line with these Terms and with any condition attached to a particular course or feature. All other uses are prohibited. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit or create derivative works from any course unless we give you explicit written permission.

J3 grants lifetime access to the courses you purchase. We reserve the right to revoke or deny access where we are obliged to disable a course for legal or policy reasons, for example if the course is the subject of a copyright complaint.

6. Payments and refunds

The training fees shown on our site are inclusive of taxes and all other charges, and are the final amount payable. You agree to pay the published fee for the course you buy, and to use only a payment method you are authorised to use.

Payment is made by transfer to the J3 bank or e-wallet account shown at checkout. You then upload a photo or file of your proof of payment together with the transaction or reference number on your receipt. Our finance team reviews and verifies every payment by hand, so there is a short period between your submitting proof and the payment being confirmed. We will tell you once it has been verified, and we will tell you, with a reason, if we cannot accept it, so that you can send a corrected receipt.

Where a course is offered on an installment plan, the schedule of amounts and due dates is shown to you before you commit, and each installment is submitted and verified in the same way.

If a payment fails or is not completed and you still have access to the course, you agree to pay the outstanding fee within thirty (30) days of our notifying you. We reserve the right to suspend access to any course that has not been paid for in full.

If you are not satisfied with a course, or you bought it by mistake, J3 may refund the training fee provided you ask within three (3) days of purchase and no certificate of completion has been issued. We are not obliged to refund a request received after that three-day limit. If a course you bought is withdrawn or disabled for legal or policy reasons, you are entitled to a refund beyond the three-day limit, within the year of purchase.

Once a refund has been issued, your access to that course ends and the account may be closed.

7. Use of content on the site

Unless we expressly say otherwise, all text, exams, video, images, exercises and other instructional material are provided for your personal use in connection with a particular course only. You agree to keep intact all copyright and other notices on any content you obtain from the site. All rights in the site and its content that are not expressly granted are reserved.

8. Disclaimers and limits on our liability

There will be times when the platform is unavailable, whether for maintenance, connectivity problems, or issues with hosting or security. You agree not to take action against J3 in those circumstances. In legal terms: the site, and any information, content or service made available on or through it, is provided “as is” and “as available” without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement, except where such a warranty cannot be disclaimed under applicable law.

J3 does not warrant that the site will operate uninterrupted or error-free, that it is free of viruses or other harmful components, or that a course or its content will meet your needs or expectations. We make no warranty about the accuracy, completeness, timeliness or quality of the site or of any course or content, or that any particular course or content will remain available.

You assume the risk of using the site and anything obtained through it. Accessing or downloading information, material or data through the site or any site it links to is at your own discretion and risk, and you are solely responsible for any damage to your property, including your computer, or any loss of data that results. You accept those risks and agree not to seek damages from J3 in respect of them.

To the extent permitted by law, J3 will not be liable for any indirect, incidental, punitive or consequential damages, including loss of data, revenue, profit or business opportunity, or personal injury or death, whether arising in contract, warranty, product liability or otherwise, and even if we were advised of the possibility in advance. In any circumstance, our total liability to you or to any third party is limited to one thousand pesos (PHP 1,000) or the amount you paid J3 in the one (1) month before the event giving rise to the claim, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so parts of this may not apply to you.

The site may link to websites maintained by others. J3 does not routinely screen, approve, review or endorse the content of those sites or the products and services offered on them, and you visit them at your own risk. To the fullest extent permitted by law, you agree that J3 will not be liable for any loss or damage, actual or consequential, arising out of or relating to these Terms, your or anyone else’s use of or inability to use the site, the placement of content on it, or reliance on information obtained through it, whether the claim is based in contract, tort, statute or otherwise. In particular, and to the fullest extent permitted by law, J3 will have no liability for consequential, indirect, punitive, special, exemplary or incidental damages, whether foreseeable or not and whether or not J3 was negligent or otherwise at fault, including claims for defamation, errors, loss of profit, loss of data or interruption in the availability of data.

9. Indemnification

You agree to defend, indemnify and hold harmless J3 and its subsidiaries, affiliates, officers, instructors, students, governing board members, agents and employees against any third-party claim, action or demand arising out of, resulting from or in any way related to your use of the site, including any liability or expense arising from any claim, loss, damage (actual or consequential), suit, judgment, litigation cost or attorney’s fee of any kind. Where this applies, J3 will give you written notice of the claim, suit or action.

10. Other terms

Termination

J3 may, at its sole discretion, end your use of the site or your participation in it, for any reason or none, with or without notice. It is our policy to terminate, in appropriate circumstances, the accounts of users who infringe these Terms. We may also cancel, delay, reschedule or change the format of any course, or stop providing part or all of the site and its related services, and you agree that J3 will have no liability for doing so. You may stop using the site at any time. The rights granted to you end when your right to use the site ends; the remaining provisions of these Terms survive.

Entire agreement

These Terms and the Privacy Policy together form the entire agreement between you and J3 in respect of your use of the site, and supersede any earlier agreement between us about it.

Waiver and severability

If J3 does not exercise or enforce a right or provision of these Terms, that is not a waiver of it. If a court of competent jurisdiction finds any provision invalid, the parties agree that the court should give effect to the parties’ intentions as reflected in it, and the remaining provisions stay in full force.

Governing law and disputes

These Terms, and any claim or dispute arising out of or relating to them or to any content or service obtained through the site, are governed by the laws of the Republic of the Philippines, excluding its conflict of law provisions. You agree that all such claims and disputes will be heard and resolved exclusively in the courts of Cagayan de Oro City, Philippines, you consent to the personal jurisdiction of those courts for that purpose, and you agree not to object to those proceedings, including on grounds of jurisdiction, venue or inconvenience of forum.
